1. Introduction

Welcome to GraphyGlance. These Terms and Conditions govern your use of our website and services. By engaging with GraphyGlance, you agree to be bound by these terms.

GraphyGlance ("we," "our," "us") provides graphic design, digital marketing, translation, AI services, video editing, and software development solutions to businesses and individuals worldwide.

2. Services

GraphyGlance offers the following services:

  • Graphic Designing (Brand Identity, Marketing Collateral, UI/UX, Print, Illustrations)
  • Digital Marketing (SEO, Paid Ads, SMM, Content Marketing, Email Marketing, Lead Funnels)
  • Translation Services (Document Translation, Localization, Legal/Technical Translation, Transcription)
  • AI Services (AI Automation, Chatbots, Content Generation, AI Analytics, Custom AI Consulting)
  • Video Editing (Short-form, Long-form, Corporate, Motion Graphics, VFX)
  • Custom Software Development (Web Apps, SaaS, CRM, Internal Tools)

3. Service Agreement

All service engagements begin with a written proposal or SOW (Statement of Work) outlining the scope, deliverables, timeline, and cost. Work commences only upon written or digital approval by the client and receipt of any advance payment specified in the proposal.

4. Payment Terms

  • Projects under ₹25,000: 100% advance payment required.
  • Projects ₹25,000 – ₹1,00,000: 50% advance, 50% on completion.
  • Projects over ₹1,00,000: As per milestone-based payment schedule in the SOW.
  • Monthly retainer packages: Billed at the start of each month.
  • Late payments beyond 15 days may incur a 2% monthly late fee.

We accept bank transfers, UPI, PayPal, and major credit/debit cards.

5. Intellectual Property Rights

Upon full payment, all final deliverables and associated intellectual property rights transfer to the client, unless otherwise specified in the SOW. GraphyGlance retains the right to showcase completed work in our portfolio and marketing materials unless a separate NDA or confidentiality clause is in place.

Source files are provided for design projects. For software projects, source code ownership is transferred upon full payment.

6. Revisions & Changes

The number of revision rounds is defined in each service package. Additional revisions beyond the included rounds will be charged at our hourly rate. Major scope changes (changes to the fundamental direction or scope of the project) may require a revised proposal and additional costs.

7. Confidentiality

GraphyGlance treats all client data, business information, and project details as strictly confidential. We will not disclose, share, or use client information for any purpose other than delivering the agreed services. We are happy to sign NDAs for sensitive projects upon request.

8. Limitation of Liability

GraphyGlance's total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project in question. We are not liable for any indirect, incidental, special, or consequential damages, including loss of revenue, data, or business opportunities.

9. Cancellation & Refunds

  • Clients may cancel projects at any time by written notice.
  • Work completed up to the cancellation date will be billed.
  • Advance payments are non-refundable if work has already commenced.
  • For monthly retainers, a 30-day notice period is required for cancellation.

10. Third-Party Tools & Platforms

Some of our services may involve third-party tools, APIs, or platforms (e.g., Google Ads, Meta, OpenAI, Gemini API). GraphyGlance is not responsible for changes, outages, or policy modifications by these third-party providers. Any costs associated with third-party tools or subscriptions are the client's responsibility unless included in the SOW.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in the relevant Indian jurisdiction.

12. Changes to Terms

GraphyGlance reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated "last updated" date. Continued use of our services after changes constitutes acceptance of the revised terms.
